Dear overnight guest, these terms and conditions of accommodation and information govern the legal relationship between the overnight guest and us, HOGASPORT Hotel-, Gastronomie- und Sportstätten-Betriebsgesellschaft mbH, Accommodation Division. Please pay attention to them, because with your booking you accept these accommodation conditions.
1. services / prices
The information contained in the prospectus is binding for us. However, we expressly reserve the right to make changes prior to the conclusion of the contract; this requires that reference be made to this before a booking is made. The services / prices stated in the catalogue are to be understood as final prices. Additional agreements that extend the content of the services are only binding upon our confirmation.
2. registration / payment
The accommodation registration is a binding offer to conclude an accommodation contract. It is also made by the applicant for all participants listed in the registration, for whose contractual obligations the applicant is responsible as for his own, provided that he has made a separate declaration to this effect. The accommodation contract shall come into effect with the accommodation confirmation from HOGASPORT Hotel-, Gastronomie- und Sportstätten-Betriebsgesellschaft mbH. Payment of the travel price must be made at the latest when the invoice is issued.
3. withdrawal - Withdrawal by the customer
You can withdraw from the booking at any time before the start of the overnight stay, this should be done in writing in your own interest. HOGASPORT Hotel-, Gastronomie und Sportstätten-Betriebsgesellschaft mbH may demand compensation for overnight accommodation arrangements made and for its expenses. Depending on the date of receipt of a notice of withdrawal, the flat rates listed below - calculated taking into account normal savings and usually possible income - will be charged (in each case as a percentage of the price of the overnight stay):
up to 31st day before travel/accommodation start 10%, at least EURO 15.00
up to the 21st day before the trip/overnight stay 20%.
up to the 11th day before the trip/overnight stay 40 %.
up to the 3rd day before the trip/overnight 80 %
there after 90 %
For group bookings of 15 persons or more, the respective percentage increases by 10 %.
Cancellation by HOGASPORT Hotel-, Gastronomie- und Sportstätten-Betriebsgesellschaft mbH
HOGASPORT Hotel-, Gastronomie- und Sportstätten-Betriebsgesellschaft mbH may withdraw from the booking up to three weeks before the start of the event.
4. obligation to cooperate, notifications of defects
The overnight stayer is obliged to cooperate within the framework of the statutory provisions in the event of service disruptions, to avoid possible damage or to keep it to a minimum. In particular, he is obliged to notify the organizer of any defects. If any disturbances occur, the overnight stay should first contact the service provider. If this is not remedied, the management must be informed. We are happy to help. If a notice of defect is given only afterwards or afterwards, we are not able to do anything either. Claims for reduction or damages are therefore excluded, unless a notification of defects would have been futile from the outset, but was culpably omitted. Likewise, self-help or a termination of the contract by the overnight stayer in the case of a considerable impairment of the overnight stay according to § 651 e BGB presupposes that the organizer has been granted a reasonable period of time to remedy the situation, unless the remedy is impossible or is refused by the organizer or if the immediate termination is justified by a special interest of the overnight stayer.
5. exclusion of claims and limitation of time
Exclusion of claims and statute of limitations: Any claims must be submitted to HOGASPORT Hotel-, Gastronomie- und Sportstätten-Betriebsgesellschaft mbH within a period of one month from the contractually agreed end of the overnight stay. The statute of limitations shall come into force 6 months after the contractually agreed end of the overnight stay; it shall be suspended if the claim is notified in good time.
6. liability for damages
The guest is liable for any damages of any kind that the overnight guest is responsible for. This also applies to any claims for damages that make it impossible to re-let the rented room in the following period. ( e.g. smoking in a non-smoking room, damage to the inventory - until the date of the room's re-rentability )
7. dispute settlement procedure
Note in accordance with § 36 of the Consumer Dispute Settlement Act (VBSG): We, HOGASPORT Hotel-, Gastronomie- und Sportstätten- Betriebsgesellschaft mbH, will not participate in any dispute settlement proceedings before a consumer arbitration board within the meaning of the VSBG and are not obliged to do so.
